The Federal High Court in Abuja is set to hear two separate motions filed by the Edo State Government and the Edo State House of Assembly challenging the reinstatement of Philip Shaibu as the deputy governor of the state.
The court, presided over by Justice James Omotosho, has fixed September 24 as the date to hear the motions. This comes after the July 17 judgment by Justice Omotosho that voided Shaibu's impeachment and ordered his reinstatement to the office of deputy governor.
In the motion dated and filed on July 18, the Edo State Attorney General, Oluwole Iyamu, SAN, is seeking two orders. Firstly, he is praying the court for an order staying the execution of the July 17 judgment pending the determination of the appeal filed against the judgment. Secondly, he is seeking an order of injunction restraining the respondents from giving effect to the July 17 judgment until the appeal is heard and determined.
Similarly, in a motion also dated and filed on July 18, the Edo State House of Assembly, represented by Ken Mozia, SAN, is seeking an order suspending the July 17 judgment and restraining Shaibu from parading himself or attending any official function as the deputy governor pending the hearing and determination of their appeal.
The applicants, in their grounds of argument, stated that they have appealed the July 17 judgment, arguing that the court lacked the jurisdiction to entertain the subject matter of the suit. They also claimed that allowing Shuaibu to resume as deputy governor would impede the smooth operation of the state government, especially given his recent open declaration of support for the rival political party, the All Progressives Congress (APC).
The July 17 judgment by Justice Omotosho had voided Shuaibu's impeachment, citing the Edo House of Assembly's failure to comply with due process in the purported impeachment proceedings. The reinstated deputy governor had sued the Inspector-General of Police, the Deputy Governor of Edo, the Attorney General, the Chief Judge of Edo, the Speaker of the Edo House of Assembly, and the Edo State House of Assembly as defendants in the suit marked FHC/ABJ/CS/478/2024.
The court's decision on the motion filed by the Edo State Government and the Edo State House of Assembly on September 24 2024, will determine the next course of action in the ongoing dispute over the deputy governorship position in the state.
